Acceptable Use Policy

This Acceptable Use Policy (AUP) lists activities that are not permitted on S Mobile Wireless service. Violations may result in service suspension or termination.

Prohibited activities

  • Unlawful activity, including the transmission of unlawful, defamatory, or infringing material.
  • Harassment, threats, hate speech, or stalking.
  • Sending unsolicited bulk messages (spam) by text, voice, or email.
  • Attempting to gain unauthorized access to any system, device, or account.
  • Distributing malware, viruses, or other harmful code.
  • Reselling service or capacity without our written consent.
  • Using automated tools (war-dialers, robocall systems, mass-text bots) without permission.
  • Tethering or hotspot use that exceeds the limits stated on your plan.
  • Activity that materially degrades network performance for other customers.

Enforcement

We may, at our discretion, suspend or terminate service for any violation of this policy. Where possible we will notify you first and provide an opportunity to cure the violation. Repeat or severe violations may result in immediate termination.

Reporting abuse

To report abuse originating from an S Mobile Wireless number, email customerservice@smobilewireless.com with details and any supporting evidence. We investigate every report.

Prohibited content

  • Child sexual abuse material (CSAM) — we report to NCMEC and law enforcement.
  • Material that violates intellectual property rights of others.
  • Material that promotes terrorism, violence against persons, or human trafficking.
  • Content that violates export controls, securities laws, or gambling regulations.
  • Content collected, generated, or shared in violation of applicable privacy law.

Network and resource abuse

  • Operating servers (web, mail, IRC, game) on a consumer plan unless expressly permitted.
  • Generating traffic that disrupts network capacity, signaling, or routing — including denial-of-service activity, port scanning, or large-scale crypto-mining over the cellular network.
  • Tethering, hotspot, or proxying that materially exceeds the device's normal use pattern or the limits on your plan.
  • Use of SIM boxes, GSM gateways, or other equipment that aggregates traffic for arbitrage or interconnection bypass.
  • Bulk or automated messaging (A2P) without a separately approved 10DLC/short-code agreement.
  • Using the service to relay spam, phishing, vishing, or smishing.

Voice service abuse

  • Robocalls that violate the Telephone Consumer Protection Act (TCPA) or TRACED Act.
  • Caller-ID spoofing intended to defraud or cause harm (in violation of the Truth in Caller ID Act).
  • Auto-dialing, predictive dialing, or war-dialing without authorization.
  • Use of the service to harass, threaten, or stalk individuals.

Security and lawful intercept

S Mobile Wireless cooperates with lawful requests from federal, state, and local law enforcement under the Communications Assistance for Law Enforcement Act (CALEA), valid subpoenas, court orders, and warrants. We will challenge requests we believe are overbroad or improperly issued.

Suspension, termination, and reactivation

We reserve the right to immediately suspend or terminate service for material AUP violations, fraud, or activity that endangers the network or other customers. Where appropriate we will notify you and provide a reasonable opportunity to cure. Repeated or willful violations may result in permanent termination and loss of any earned credits, rewards, or promotional value.

DMCA notices

If you believe content transmitted over our service infringes your copyright, send a notice that meets the requirements of 17 U.S.C. § 512(c)(3) to our designated agent at customerservice@smobilewireless.com (subject line: "DMCA Notice"). Counter-notices should be sent to the same address. We will act on properly formatted notices in accordance with the DMCA.

Updates to this AUP

We may update this Acceptable Use Policy from time to time to reflect changes in law, technology, or network conditions. Material updates take effect 30 days after they are posted unless a shorter period is required by law.
