Data Services Agreement

This Data Services Agreement covers data-only plans (Air Standard, Air Premium, mobile hotspot plans) and any other broadband data service from S Mobile Wireless.
Service description
Data services provide internet connectivity over our wireless network. They do not include voice calling or text messaging unless explicitly stated on the plan.
High-speed data
Each plan includes a stated amount of high-speed data. After you exceed that amount, speeds may be reduced for the remainder of your billing cycle as described on the plan page. Reduced-speed data is sufficient for browsing and email but may not support video streaming.
Equipment
Some data plans require approved equipment (router, mobile hotspot, or 5G receiver). Equipment may be purchased outright or financed. Damage caused by misuse, modification, or exposure to liquids is not covered.
Acceptable use
Data services are subject to our Acceptable Use Policy. Server hosting, peer-to-peer file sharing at large scale, and activities that materially degrade the network for other customers are not permitted.
Network management for data plans
To maintain quality for all customers, data customers who exceed plan thresholds may be de-prioritized during periods of network congestion. Once congestion subsides, normal speeds resume. Reduced-speed thresholds (where applicable) are disclosed on each plan page.
Permitted uses
- Personal and small-business internet access at a fixed or temporary location.
- IoT and connected-device deployments, subject to a separate IoT addendum where applicable.
- Backup connectivity for primary wireline broadband.
- Travel and field connectivity (within the United States; international roaming requires an add-on).
Prohibited uses
- Reselling data capacity to third parties without our written authorization.
- Operating high-volume web, email, file, or game servers.
- Continuous bandwidth-intensive automated traffic (e.g., large-scale crawling, mining) over the cellular network.
- Use of SIM aggregation hardware or signaling abuse.
Service-level expectations
Consumer data services are provided on a best-effort basis with no specific uptime guarantee. Business data customers may purchase a service-level addendum with defined targets and credits.
Privacy and security
Data service customer information is handled as described in the Privacy Policy. We use industry-standard encryption, fraud detection, and DDoS mitigation to protect data customers.
Termination and equipment return
On termination, leased or financed equipment must be returned in good working order within 30 days. Unreturned or damaged equipment is billed at the published replacement value.
International data
Domestic data plans do not include international roaming. International data is available through Travel eSIM (worlddataplans.com) and Global eSIM (smobilewirelessglobal.com), each governed by its own terms.
Limitation of liability and dispute resolution
Liability for data service interruption is limited to a pro-rated credit. Disputes are resolved through binding individual arbitration as described in our Terms & Conditions.
