These Terms & Conditions govern your purchase and use of S Mobile Wireless service, devices, accessories, and our websites. By activating service or placing an order, you agree to these terms.
Service eligibility
You must be at least 18 years old and provide accurate billing and contact information to open an account. Service is provided in the United States and its territories on a month-to-month basis with no long-term contract required.
Billing and charges
Monthly plan charges are billed in advance. One-time charges (device purchases, activation fees, taxes, and regulatory surcharges) are billed at the time of purchase. Payment is processed via the card on file unless you authorize a different method.
Cancellation
You may cancel service at any time. Cancellation takes effect at the end of the current billing cycle and is non-refundable for that cycle except as required by law. See the Refund Policy for details on device returns.
Acceptable use
Service may not be used for unlawful activity, to harass others, or in ways that disrupt the network for other customers. See our Acceptable Use Policy for the full list of prohibited activities.
Dispute resolution
Most disputes can be resolved by contacting customer support. By using S Mobile Wireless service, you agree that any unresolved disputes will be resolved through binding individual arbitration rather than class action, except where prohibited by law.
Changes to these terms
We may update these terms from time to time. Material changes will be communicated by email or in-app notice at least 30 days before they take effect. Continued use of the service after that date constitutes acceptance of the new terms.
Acceptance and scope
These Terms & Conditions, together with the Consumer Service Agreement (for consumer lines), the Data Services Agreement (for data-only and broadband lines), the Acceptable Use Policy, the Open Internet Policy, the Privacy Policy, and any plan- or device-specific disclosures, form the complete agreement between you and S Mobile Wireless USA, LLC ("S Mobile Wireless," "we," "us"). In the event of a conflict, plan- or service-specific terms control over these general terms.
Devices, SIMs, and eSIMs
Devices purchased from S Mobile Wireless must be activated on our service unless sold expressly as unlocked. SIM cards and eSIM profiles remain the property of S Mobile Wireless and are licensed to you for use only with active service. Tampering, cloning, or reselling SIM/eSIM credentials is prohibited and may result in immediate termination.
Taxes, fees, and surcharges
Advertised prices generally do not include applicable federal, state, and local taxes; 911 fees; Universal Service Fund (USF) contributions; or regulatory recovery surcharges, which will be itemized on your invoice and may change without notice as required by law.
Late payment, suspension, and collections
If a payment is not received by the due date, we may charge a late fee permitted by law, suspend service after notice, and ultimately terminate the account. Reactivation may require payment of past-due balances plus a reactivation fee. Unpaid balances may be referred to a third-party collection agency and reported to consumer reporting agencies.
Limitation of liability and indemnity
To the maximum extent permitted by law, S Mobile Wireless is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits or data, even if advised of the possibility. You agree to indemnify and hold S Mobile Wireless harmless from claims arising out of your violation of these terms or misuse of the service.
Arbitration and class-action waiver
Except for small-claims actions and claims for injunctive relief to protect intellectual property, you and S Mobile Wireless agree to resolve disputes through final, binding individual arbitration administered by a recognized arbitration provider in your state of residence, governed by the Federal Arbitration Act. You waive any right to participate in a class, collective, or representative action. You may opt out of this arbitration agreement by emailing customerservice@smobilewireless.com within 30 days of activation.
Governing law
These terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law principles, except where preempted by federal law. Venue for any non-arbitrable dispute lies in the state or federal courts located in Jefferson County, Alabama.
